Robinson Successful in NC Court of Appeals

The unanimous December 3rd opinion from the Court of Appeals concluded the State failed to lay the proper foundation to admit the breath test results from the Intoxilyzer EC/IR II, that the admission of the breath results constituted prejudicial error, and that this error entitled their client to a new trial. The Court of Appeals decision adopted the analysis advocated by Les Robinson to conclude the admission into evidence of breathalyzer result was reversible error.
